At times, the Friend of the Court may seek to withhold an income tax refund of a payer of child support to apply the funds to the payer's child support arrearages. If the tax refund is based on a joint income tax refund, the spouse of the payer may file an Injured Spouse Claim as to the portion of the joint refund that is due the spouse of the child support payer.
At times, the spouse of the child support payer may agree to waive any claim the spouse may have to the joint income tax refund so that the entire income tax refund proceeds may be applied to the payer's child support obligation.
