[ARCHIVED] Open Meetings Emergency Provisions Extended
With the March 31, 2021 expiration of the amendment within Public Act 254, allowing electronic meetings for any reason, some questions have surfaced. It is our understanding at this time that the amendment will not be extended, therefore the “any reason” provision will no longer apply. That being the case, a temporary resolution (until Dec 31, 2021) is for jurisdictions to declare a local state of emergency. If a county declares such, local public bodies may fall under that umbrella and would be able to continue virtual meetings. As of 3/17/2021 the Eaton County Board of Commissioners has approved a resolution authorizing the declaration of a State of Emergency for Eaton County. The resolution has been approved for renewal every 7 days (per PA 390) and will be reviewed for renewal on a monthly basis (next review will be at the regular Board of Commissioners meeting on 4/21/2021).
If a public body wishes to have in person meetings, they should be mindful of not only the posting requirements (as always), but the gathering limitations as dictated by MDHHS orders.
